Your Pictures' Copyrights

Portraiture and Copyright When you have your portrait shot by pcPix.com, who owns the pictures? On one hand, you've paid for the photographer's time and might expect that the images are your property. On the other hand, the photographer's compensation is based on the intended use of the pictures as your personal portraits. Therefore, pcPix.com retains ownership of the copyright, but grants you the perpetual right to make unlimited noncommercial use of your images.

By law, the ownership of the copyright for your pictures belongs to the photographer as soon as the images are created. All our photographers sign agreements with pcPix.com transferring these copyrights to pcPix.com, which retains ownership of the copyrights. This allows pcPix.com to grant you a license to use the pictures.

What You Can Do With Your Pictures Though pcPix.com retains the copyright to your pictures, pcPix.com grants you a very liberal license to use the images. This license for unlimited noncommercial use means you're able to post your pictures on the web, make prints in any quantity, and generally use them as you please without further payment to pcPix.com. The only exception is that you cannot use them commercially; that is, you cannot sell them to a magazine, you can't use our photograph as the new Gerber baby bottle image, etc. You may enter your photographs in contests as long as pcPix.com is credited in all uses of the image; prize money in excess of $400 is presumed to be commercial use and requires licensing in advance. Basically, pcPix.com wants appropriate credit for its work, and requires licensing in advance for any commercial use.

What pcPix.com Can Do With Your Pictures Unless you sign a Model Release, pcPix.com will not use your pictures for any purpose other than providing you the service you've paid for. Therefore, absent a Model Release, your pictures will go on the pcPix.com website only if you've specifically asked them to be posted there (for example, you may want to review your proofs via the Web), and will be removed as soon as your use of them is complete. pcPix.com will never use your pictures for any promotional or commercial purpose without a prior agreement as recorded in a Model Release.
